The
Vice-President of India and Rajya Sabha Chairman Venkaiah Naidu on Monday (23-April-2018) rejected the
impeachment notice that was sent to him by Congress-led opposition parties to oust the Chief Justice of India
Dipak Misra.
This was done after Mr. Naidu held consultations on the impeachment notice with constitutional and legal experts, including
Attorney General KK Venugopal, and former top law officer
K Parasaran, according to a PTI report. Earlier, over the weekend the Congress leaders said that the party might move to the Supreme Court if the notice to impeach is rejected. They said if the Upper House Chairman did not find merit in the notice for the impeachment, the decision could call for a judicial review.
The Opposition parties had alleged that the CJI Misra, who is set to retire on October 2, 2018, was assigning essential cases to junior judges. In the past, there have seen six attempts to impeach judges of constitutional courts, all of which have been dissolved.
