Madhya Pradesh HC Grants Bail to Two People Accused of Hoisting Pakistani Flag

The bail has been granted to the nephew-uncle duo by the Madhya Pradesh High Court after it was found that the flag unfurled by the petitioners and the Pakistani flag were different and even appreciated them for showing the patriotism towards their motherland when they voluntarily promised to hoist the national flag too. 

The bail application of the petitioners was heard under section 439 of CrPC by the High Court. The petitioners were accused of unfurling the Pakistani national flag on their house. The counsel of petitioners submitted that the flag which was unfurled was not the Pakistani national flag but rather a symbol of their religion which is unfurled during religious occasions. 

The petitioner's counsel presented two different pictures of the flags and pointed out the differences in them and explained how these two flags are different from each other and proved that it was not a Pakistani National flag.

After the submissions of facts and evidence finding satisfactory, the granted bail to the uncle-nephew duo. As per the Court’s direction, the petitioners were supposed to furnish a personal bond in the sum of Rs.30,000 each with one solvent surety each to the satisfaction of the Trial Court. 

As per the submissions of the counsel for petitioners, the petitioner promised voluntarily that they will hoist the Indian national flag on their house every day or on special occasions and they will be proud to do so, to which the Court said, “The Court appreciates the sentiments and solicitude of the petitioners towards the motherland”.
