SC states that Repetitive Filing of Applications Amounts to Abuse of Process of Law, Slaps Rs. 25K Costs on Adarsh Scam Accused

Raj Kumar Modi, an accused in the Adarsh Scam Case has been fine imposed of Rs. 25000 by the Hon’ble Supreme Court for repetitive interim bail applications. Modi was granted bail by the Court on 15.06.2020 for two months in respect of his mother being seriously ill. Thereafter he filed another application for bail extension for the next 6months suggesting his mother being passed away and he has to perform some rituals.

He submitted another bail extension application claiming his wife is suffering from serious ailments. This was disposed for another one month and it was clearly mentioned no such bail extension will be entertained hence after. Thereafter the accused filed another application for interim bail extension on the ground of his own serious medical issue. 

However, observing such repetitive filing, a bench consisting of Justice L. Nageswara Rao, Hemant Gupta, and S. Ravindra Bhat dismissed the application noting that repetitive filing of an application for bail extension is abuse and mockery of Law and it shall not be entertained on any ground of aspects. The bench further stated that it was previously ordered by the Court that no bail extension would be granted and despite such order, the repetitive filing of applications by the accused suggests dismiss of the application at an exemplary cost.

Therefore, the accused has been imposed with Rs 25000 for such an act. The court further ordered to take necessary measures to provide adequate medical attention to the accused.
