‘How much time does it require to pass order in an anticipatory bail,’ SC in ex minister Murder case

NEW DELHI: The Supreme Court on Tuesday said it is not happy as the Telangana High Court could not despite anticipatory bail of Lok Sabha M P Y S Avinash Reddy, an accused in the murder case of former Andhra Pradesh Minister Y S Vivekananda Reddy, despite hearing the matter twice.

"We are not happy with it that the High Court is not passing an order even after our order. How much time does it require to pass order in an anticipatory bail," a vacation bench of Justices J K Maheshwari and P S Narasimha said.

The court refused to grant any protection to Avinash, the leader of the state's ruling party leader against the summons issued by the CBI.

The court ordered for placing the matter before the High Court on May 25.

During hearing, the court was apprised the matter has yet not been decided by the High Court despite hearing it twice.

Senior advocate V Giri, for Avinash Reddy, submitted that the anticipatory bail plea was taken up by the High Court on two dates.

He agreed that it was an anticipatory bail hearing and order should have been passed one way or the other.

Senior advocate Sidharth Luthra, on behalf of Suneetha Reddy daughter of Y S Vivekananda Reddy, said the MP had choosen to get himself admitted first in his relative’s hospital and then in another hospital.

“What he has done yesterday….. he created a law and order situation,” he claimed.

The bench, however, said it will not go into the merits of the matter.

The court was hearing an application filed by N Suneetha Reddy, the daughter of the slain former minister, challenging the decision of the Andhra Pradesh High Court to grant Lok Sabha MP, Avinash Reddy, interim protection from arrest.

Vivekananda Reddy, one of the brothers of the late Andhra Pradesh Chief Minister Y S Rajasekhara Reddy, and uncle of Chief Minister Y S R Jagan Mohan Reddy was found murdered at his residence in Pulivendula in Kadapa district, on the night of March 15, 2019, weeks before the Assembly elections in the State.

Acting to the victim's daughter, investigation has revealed that the scene of offence was cleaned and the wounds on the body were wrapped up with bandages to give credence to the story of death due to a heart attack allegedly in the presence and at the behest of Y S Avinash Reddy, Y S Bhaskar Reddy and D Shiva Shankar Reddy, among others.

On April 24, the top court had criticised for the High Court's direction to the CBI to quiz Kadapa MP in Q and A form in the case.
