On Monday (July 2nd, 2018) Rohini District Court directed the city police to register a case against Mahaakshay Chakraborty son of veteran actor Mithun Chakraborty, and his mother former actress Yogita Bali in connection with a rape complaint filed by a Bhojpuri actress and forcing her into an abortion.

Mithuns wife Yogita Bali has also been accused of allegedly threatening the woman later.

Additional Chief Metropolitan Magistrate Ekta Gauba said Keeping in view the high and influential status of the respondents being the son and wife of renowned and veteran actor Mithun Chakraborty who was not only the Bollywood Superstar of yesteryears, but also former Rajya Sabha MP. The complainant has verbally alleged that her parents are not alive and she has some relatives and friends in Delhi; there is a threat to her life as well as freedom in Mumbai because of the threats issued by the respondents, and Considering the fact that the complainant is frightened to enter Mumbai without legal protection. Even considering the threats given to the complainant from the respondents who are influential people. This shows that investigation by the police is necessary to unearth the conspiracy and to collect evidence and to secure the presence of the accused.

In her complaint, Bhojpuri actress said that Mahaakshay Chakraborty cheated and raped her on the pretext of marriage, and when she got pregnant, he forced her to abort. She accused Yogita Bali of threatening her with dire consequences if she continued the relationship. She said she moved from Mumbai to Delhi as she feared for her life there.

As per the accusations made by the Bhojpuri actress, the court has said that the investigation by the police is necessary "keeping in view the high and influential status of respondents 1 and 2 being the son and the wife of renowned and veteran actor Mithun Chakraborty."

The court further said that according to law, there are sufficient grounds to register an FIR under section 376 (Punishment for rape), 328 (Causing hurt by means of poison), 313 (Causing miscarriage without womans consent), 417 (Punishment for cheating), and 506 (Punishment for criminal intimidation) of the Indian Penal Code, 1860.
