New Delhi: In a significant development, the Jodhpur High Court on Wednesday granted bail to 86-year-old Asaram Bapu on medical grounds, mirroring the relief granted by the Supreme Court earlier this week in a separate Gujarat case. The decision allows Asaram to walk out of jail for the first time since his arrest in 2013, after more than a decade behind bars.
SC Relief in Gujarat Case Leads to Bail From Jodhpur High Court
The Jodhpur High Court’s order follows the Supreme Court’s decision on January 6, where the bench of Justice M M Sundresh and Justice Rajesh Bindal granted temporary medical bail to Asaram till March 31, 2025. The relief was granted solely on humanitarian grounds, citing his advanced age and deteriorating health.
Asaram Bapu’s Legal Battle: Bail Approved Following SC Intervention
In the Supreme Court case, Senior Advocate Devadatt Kamat, with Advocates Rajesh Gulab Inamdar and Shashwat Anand, appearing for Asaram, had pressed arguments both on the merits of the conviction and on medical grounds. On merits, they pointed out inconsistencies in the prosecution’s case and argued that the conviction relied solely on the uncorroborated testimony of the prosecutrix. However, the Court chose to limit its consideration to the petitioner’s health condition.

On medical grounds, the counsel highlighted Asaram’s multiple heart attacks, severe comorbidities, and fragile health, arguing that continued incarceration posed a significant risk to his life. Solicitor General Tushar Mehta, appearing for the State of Gujarat, opposed the plea, contending that adequate medical facilities were available in custody and emphasizing the seriousness of Asaram’s conviction.

Ultimately, the Supreme Court granted temporary relief, permitting Asaram to seek medical treatment outside prison. This relief formed the basis for similar arguments in the Jodhpur High Court, leading to his release from custody.
