CA Exams 2021: Plea in Supreme Court Seeks Opt Out Option, More Examination Centres, Postponement of Exam if Adherence to COVID Protocols not Possible

A petition has been filed against the notification issued on 5th June 2021, by the Institute of Chartered Accountants  of India(ICAI) with the Supreme Court seeking directions to provide a "Opt Out" option to all aspirants who will appear in the CA exams which are going to conduct from 5th June 2021, and who are willing to opt out before and during the exam, with a carry forward of all benefits.

The petition also requested for an extra attempt for Intermediate and Final Year students who are taking the old syllabus.

The child Rights Activist Anubha Shrivastava Sahai has filed the petition. The petition seeks directions for increasing the number of Examination Centres for CA Exams,  in order to ensure that, in each district of country at least one examination centre has kept. At one centre not more than 50 students should be allowed .

Further instructions have been sought to establish a stand-by Examination Center for those Centers during examination ,that are likely to enter the containment zone.

For the CA examinations, the petitioner has requested for the formulation and implementation of specific MHA guidelines , free medical treatment for students infected during examinations, staggered examinations, and free vaccination for all students/candidates, other staff, and invigilators, among other welfare measures.

The petitioner has urged that if adherence to the COVID-19 safety measures, including vaccination of all students, staff, and invigilators is not possible, then as an alternative, the ICAI should postpone the examination untill the COVID-19 crises has subsided. 

In order to protect the students from the high risk of COVID-19, the petitioner has requested the Supreme court to issue the directions for the free transportation and free accommodation for those students who do not live in close proximity to their respective exam centres. 

In order to ensure smooth movement of students Admit cards may be treated as E-pass for the students in containment or red zones during the examinations.

Furthermore, the ICIA has been directed to declare results with a specific frame of at least 7days before the start of next exam/cycle
