Complaints Against Judicial Officers Must Accompany Sworn Affidavit & Verifiable Materials: Andhra Pradesh HC Issues Additional Guidelines [READ GUIDELINES]

The Chief Justice of India had prescribed certain guidelines to be followed by any person making allegations against judicial officers in the subordinate judiciary. To those guidelines, the Andhra Pradesh High court added some additional guidelines relating to the Pre-Requirements for filing such complaints as mentioned by the Chief Justice of India. 

The additional guidelines were-

  1. Anyone making a complaint against any member of the Subordinate Judiciary in the State must accompany the complaint a duly sworn affidavit or any material to support his allegations or complaint.
  2. If the condition mentioned in (1) is not satisfied, the complaint will not be entertained.
  3. If the condition mentioned in (1) is satisfied, the Hon'ble Chief Justice may direct inquiry into the complaint.
  4. If after the inquiry, the allegations are found to be true then actions will be taken against that member.
  5. If after the inquiry, the allegations are found to be false then the complainant will be ordered to pay costs.

Justice TS Thakur, while he was the Chief Justice of India, directed all the High Courts to follow the above guidelines when receiving any complaint against members of judicial officers.
