Law graduate files plea in High Court challenging Bihar Mining Corp selective recruitment process for CNLU graduates only [Read PIL]

A plea has been filed in the Patna High Court challenging Bihar State Mining Corporation Limited's recruitment notification for the post of Law Officer on the grounds that it enables only Chanakya National Law University, Patna (CNLU) law graduates to apply.

On December 16, the Mining Corporation Limited sent a letter to the CNLU Vice-Chancellor with the intention of hiring 10 law students for the position of Law Officer. As a result, the University administration informed its students about the position and encouraged them to apply by submitting their CVs and other information.

Saurav Narayan, a law graduate of Delhi University (Law Centre-I, Faculty of Law), wrote a representation to the Corporation's CEO opposing the proposal; however, no action was taken, therefore, Narayan has now filed a writ in the High Court.

The petitioner claimed before the Court that despite graduating from one of the country's most prestigious universities, he is unable to apply for a job as a law officer at the Bihar State Mining Corporation, which is a clear violation of the Fundamental Right to Equality enshrined in Article 14 of the Indian Constitution.

The petitioner has challenged the selective procedure, claiming that the Bihar State Mining Corporation, Government of Bihar, did not follow the proper procedure for notification of appointment and that it is biased, and that one specific university was given the benefit of applying and being appointed thereon.

" ...this entire process of notification of appointment is arbitrary and illegal, which deprives and excludes the Petitioner who had obtained LL.B. Degree from Delhi University, Delhi from competing for the post of Law Officer in the Bihar State Mining Corporation, Government of Bihar...,"

Prayers :

Direct the Respondent Authorities to immediately revoke the offer letter dated 16.12.2021, wherein the Registrar of the CNLU has been requested to send a list of 10 Law Graduates from the University for appointment on the post of Law Officer in Bihar State Mining Corporation Limited.

)Direct the Respondent Authorities to initiate fresh appointment process for the post of Law Officer in Bihar State Mining Corporation Limited which should be open for all candidates to apply irrespective of the University from where they have completed their Law degree.

)Direction to the Respondent Authorities to ensure that the adequate reservation procedure is followed as per the guidelines issued by the Hon'ble Supreme Court of India in the case of Indira Sawhney v. Union of India, A.I.R 1993 SC 477.

The petitioner has been represented by advocate Vishal Kumar Singh.
