Petition Filed In SC Demanding Withdrawal Of Justice Kants Remarks On Nupur Sharma [Read Petition]

A letter petition in the form of a PIL has been filed in the Supreme Court of India demanding the Supreme Court Bench headed by Justice Kant to withdraw the remarks against Ex BJP Spokesperson Nupur Sharma.

The PIL has been filed by Mr. Ajay Gautam who is a social activist.

The Supreme Court today refused to give relief to Nupur Sharma who had pleaded to transfer all her FIRs to Delhi. Refusing to grant relief, Bench headed by Justice Kant made certain observations about Nupur Sharma as under:

  1. Nupur Sharma is responsible for Udaipur murder case;
  2. She is responsible for fire in the country;
  3. She should tender apology before TV unconditionally;
  4. She hurt the religious sentiments of a particular community;
  5. Whatever happened in the country, only Nupur Sharma is responsible;
  6. Police failed to arrest Nupur Sharma;
  7. She is single handedly responsible for what is happening in the country;
  8. Sharmas loose tongue has set the entire country on fire;
  9. Her outburst is responsible for the unfortunate incident at Udaipur

The Petition states that the above observations and remarks made by the Supreme Court are unwanted, uncalled for and without any merit, therefore liable to be withdrawn. 

The substantial question of law raised in the petition is:

Whether without trial or appeal or any judgement or finding of any court can this court make such statements which effect merit of the case as well as trial?

The petitioner prays to issue appropriate orders or directions to the Bench of HMJ Surya Kant to withdraw their observation in the matter of Nupur Sharma so that she can get a fair chance of trial.
