Punjab & Haryana High Court Reject Writ Petition Stating Married Woman In A Live-In Relationship Not Entitled To Protection  [READ ORDER]

The High Court of Punjab and Haryana recently rejected a writ filed by a married woman seeking protection against her husband, the appellant is in a live-in relationship.

FACTS

The appellant alleged that her husband was mentally and physically abusing her. Furthermore, she stated that she left her matrimonial house and was currently living with her partner in a live-in relationship. 

However, the respondents were against this alliance and intend to harm her. Therefore she pleaded in the court for protection. 

COURT’S JUDGEMENT 

The court held that the petitioner is living in an “unholy” Alliance with her partner and has not taken a divorce from her husband. Furthermore, the court held that the petitioner has no material evidence to support her allegations against the respondent due to which the extra-ordinary writ petition cannot be exercised.
