SC to Live Stream Proceedings  in 5-Judge CB Hearings From Today

NEW DELHI: The Supreme Court is all set to live stream its Constitution bench proceedings from Tuesday, in a decision seen as historic and pathbreaking to bring in transparency in judicial decision making process.

Three separate five-judge Constitution benches are scheduled to assemble on Tuesday.

A five-judge bench headed by Chief Justice of India U U Lalit would continue to hear the validity of 10% quota for Economically Weaker Sections in jobs and education.

Another five-judge bench headed  by Justice D Y Chandrachud would take up a matter related to control of services in an ongoing tussle between Delhi and the Union government, while yet another five-judge bench headed by Justice Sanjay Kishan Kaul would hear the validity of All India Bar Examination.

The decision to live stream proceedings comes four years after the Supreme Court in its judgement in 'Swapnil Tripathi' (2018) case, favoured it in important cases.
 
The top court had then said, "Live-streaming of proceedings is crucial to the dissemination of knowledge about judicial proceedings and granting full access to justice to the litigant, which can never be complete without the litigant being able to see, hear and understand the course of proceedings first hand."

Apart from this, live-streaming is an important facet of a responsive judiciary which accepts and acknowledges that it is accountable to the concerns of those who seek justice. Live-streaming is a significant instrument of establishing the accountability of other stake-holders in the justicing process, including the Bar.

Moreover, the government as the largest litigant has to shoulder the responsibility for the efficiency of the judicial process. Full dissemination of knowledge and information about court proceedings through live-streaming thus subserves diverse interests of stake holders and of society in the proper administration of justice, it had said.
