Supreme Court to hear plea seeking action against alleged hate speeches at the Dharam Sansad event held in Himachal Pradesh [Live Update]

Bench: This is that Himachal matter.

Sibal: In this matter, kindly have a look at page 9.

Bench: Your original WP is for UK & Delhi? 
Sibal: They have been holding Dharam Sansad throughout the country. It was in Una. They had said you report it to the collector & SP.

Sibal: The collector & the SP did nothing.

Sr Counsel now refers to the transcripts made during the meet. Please read page 8 & 9. Then turn to page 10.

Bench: In those earlier decision, preventive action. Guidlines are already there.  

Sibal: Yes, but they have done nothing.

You have to follow the guidelines and if they are not being followed, you will have to answer.

Counsel for State: We are taking preventive measures.

Bench: Not only that, you have to stop the activity. These events don't occur suddenly and are announced in advance. Your police needs to ensure that nothing happens.

Let them (state's counsel) give an affidavit, saying what steps have been taken.

Sibal refers to Poonawaala's judgement. Now they are holding another Sansad in Roorkee.

Bench to counsel for UK: If that announcement has been made, you will have to take action. Next week there is going to be some other fucntion. You will have to follow the guidelines.

Counsel for UK: We registered 4 FIR's relating to 1 community A & then another FIR to another community B. As regards preventive, there is difficulty here. If they say that they are going to be a sansad, we don't know what would be the text.

Bench: The speaker will be the same. You take actions. Dont make us say what we dont want to speak.

Counsel for UK: We are taking steps and instructions. Let them have faith on us.

Bench to counsel for UK : You talk to the Secretary and IG of that area. The prob is not about trust but what we see is something else on ground. Despite the 2018 judgement, yet things are happening.

Counsel for UK: My friend is trying to colour a particular community. We are taking steps & we will take steps that nothing happens.

Bench: We are putting on record now. You know what are preventive meausres, you will have to do it. & if it happens we'll ask the CS to be present. We are directing you to take all these steps. You are bound to. You are not doing favour on us by following the directions.
