Supreme Court to hear plea challenging  HMOIndias notification refusing to renew registration of close 6000 NGOs under FCRA.

Plea also seeks for extending validity of reg of orgs that failed to apply for renewal of registration till CoVID remains as notified disaster"

Sr Adv Sanjay Hegde for the petitioner (Global Peace Initiative)

Bench to Sr Adv: In morning you weren't seen in the screen so we proceeded with the matter.

Hegde: These are very brief prayers. Pet was filed on Jan 4. Prayer A & B were alive at that time & now they're not.

There are 1000's of org who are doing good work.

Hegde: Govt earlier has taken note and considered. Till CoVID is a notified disaster, there is no heavens will fall kind of situation where everything has to shut down.

Bench: Mr SG, have you taken instructions?

SG: Pub spirited person should be aware of the facts.

SG: Under staute, there is time limit. Approx 11k NGO's have applied for renewal & their reg has been extended. Govt is concious of that situation. I don't know what is the purpose of this PIL. Something is amiss.

Bench: Those who have applied, are there names in pub domain?

SG: Houston based person is not supposed to be concerned.

Hegde: Approx 6K NGO's have not applied....

Bench: If those 6k NGO's have not applied under the current regime, they have chose not to continue in the current regime.

SG: How is houston based ass'n considred with this?

Bench: We will say that matter can wait till judgement is passed. interim relief need not be granted. Brothers?

Hegde: If your lordship could make it clear that within 2 weeks those NGO's could apply. A request to the SG.

ORDER 
We have heard counsel on matters of interim relief. Petitioner have sought interim direction that reg of all those NGO's that was valid till 20th should continue till further order.

ORDER 
SG submits that those 11594 NGO's who have already applied for reg within the cut of time, their previous reg has been extended. In light of the stand taken by the authorities we do not intend to pass interim order.

ORDER 
Petitioners are free to make representation to the authorities which may be considered by them in acc with law. This WP 566/2021 be listed after the judgement is pronounced.

SC refuses to pass interim order to protect around 6000 NGOs whose FCRA registration did not get renewed and asks them to make representation to Centre which would would take decision as per law.
