SC is hearing a petition filed by VP of the Sikkim Democratic Front challenging appointment of Sikkims CM

Supreme Court Vice President Sikkim Democratic Front Chief Minister

Supreme Court is hearing a petition filed by Vice President of the Sikkim Democratic Front challenging appointment of Sikkims Chief Minister & reduction of his disqualification from 6 to 1 years.

Sr Adv GV Rao for petitioner: The Petitioner is VP of a political party in Sikkim. Earlier we had filed a writ where we challenged invitation to CM who was prevented under the PC Act.

Rao: Acc to previous judgement in Jayalalitha case, person is to be disqualified for 6 years. He moved EC for a waiver. We have challenged ECs order saying that once theres a judicial order for disqualification of 6 years that cant be overlooked to make a waiver.

Sr Adv Mukul Rohatgi on caveat: The same party has filed the same petition before the Delhi HC.

Rao: well get it transferred.

Rohatgi: They wanted transfer of Delhi Petition to this court which was refused.

Bench: question is, its a legal issue which has to be decided

Bench: We are issuing notice.

CJI: When already someone from your side filed a writ before Delhi HC, why have you filed again?

Rao: I wasnt aware of those writ petitions.

CJI: why have you chosen so many forums youve to explain. Some legal issue is there only thats why we are issuing notice.
