The disciplinary committee of the Bar Council of India passed an interim stay on part of the impugned order of Bar Council of Delhi by which general advocates/ Bar Associations have been restrained from holding any religious functions/ programme/ activities in their chambers or in the premises of the Bar Associations.
The committee stated that passing such kind of a restraining order is beyond the jurisdiction of the Bar Council, especially when any issue is not there. "The Bar Council of India Rules don't place any such prohibition on Advocates," it said.
These directions came in the wake of a case concerning an Advocate who was accused of performing religious conversion and performing Nikah in his Chamber.
The complaint was dismissed by Bar Council of Delhi, though the impugned general directions were issued as a control measure.
