Three Convicts Reply To Tihar Jails Notice To File Mercy Petition Within 7 Days Saying Remedy Of Curative Petition Still Available [Read Reply]

The three convicts from the Nirbhaya Gangrape case today (December 24, 2019) filed a reply to Tihar Jails authorities saying that the remedy of filing a curative petition against the dismissal of review petition before the Supreme Court is still available. After exhausting all judicial remedies available, they would file a mercy petition before the President.

The notice further pointed out that the notice sent by Tihar jail has caused immense distress because the notice has given the convicts a 7-days ultimatum for filing a mercy petition after which their execution sentence would be carried out. 

The Tihar Jail had issued a notice to all four convicts in the Nirbhaya Gangrape and murder case on December 18, 2019 asking them to file mercy petitions within 7 days from the date of notice. The notice said that their rights would be forgone and legal proceedings would be initiated against them after the expiry of 7 days.

Additionally, the reply said that Tihar jails notice defied basic principles of natural justice and judicial precedents set by the Supreme court in the case of Shabnam v. Union of India.
