BENGALURU: M/s. Betterplace Safety Solutions Pvt. Ltd has moved has moved the National Company Law Tribunal, Bengaluru against delivery app, Dunzo Digital Pvt. Ltd. over pending dues.
A coram of judicial member Justice T Krishnavalli and technical member Manoj Kumar Dubey issued notice in the plea and has asked the corporate debtor (Dunzo) to reply within two weeks. The matter will next be heard on March 4.
Issue Notice to the Respondent/Corporate Debtor. Registry is directed to prepare the notice and Counsel for the Petitioner is permitted to collect the notice and serve it personally on the Managing Director of the Respondent Company and also on the Respondent Company along with Company petition and other material papers through email as well as by speed post and is directed to file affidavit of service along with tracking report in the Registry, within two weeks.
The plea to initiate corporate insolvency resolution process (CIRP) under Section 9 of the Insolvency and Bankruptcy Code, 2016 (IBC) was submitted in November, last year.
The outstanding debt owed by Dunzo to Betterplace stems from various services provided, including background verification, recruitment of delivery personnel, asset management, and merchandise, all delineated within a master service agreement and platform subscription agreement.
Despite granting multiple extensions, Dunzo has allegedly failed to settle these outstanding dues, prompting Betterplace's to pursue legal recourse.
