Dilip Chhabria granted bail in Avanti Scam Case by Mumbai Court

Dilip Chabbria was granted bail on April 3, 2021 in the Avanti Scam Case by the Esplanade Magistrate Court in Mumbai.

When it comes to customised cars, Dilip Chhabria is a well-known name, and his signature 'DC' style has been highly sought after, with many celebrities among his customers.

Dilip Chhabria was arrested by Milind Bharambe, Joint Commissioner of Police (Crime), who said on Tuesday that approximately 90 DC Avanti vehicles made by Dilip Chhabria Designs Pvt Ltd (DDCPL) were used for fraudulent financing. DDCPL took out several loans totalling Rs 42 lakhs on these vehicles. The corporation will impersonate clients for their own vehicles and obtain loans from non-banking financial companies (NBFCs) that were never paid back. Such cars were then sold to other buyers after illegal funding was obtained without the consent of the buyer. 

This also included a registration scam where the majority of the 90 vehicles were registered with two or three RTOs from different states, according to the police. The petitioner, in this case, is a Tamil Nadu resident whose DC Avanti system and frame number were registered with both the Tamil Nadu and Haryana RTOs. The cops suspect they'll use these multiple identification numbers to get more loans that they won't be able to pay back.

In the Avanti case, Dilip Chhabria is being represented by Arguing Counsel Akhilesh Dubey along with Amit Dubey.

The whole prosecution case seems to be suspicious. Surprisingly, the first informant is a Chennai native. The driver, however, was intercepted by the CIU unit on December 17, 2020, in Colaba, Mumbai. Aside from that, on December 31, 2019, the first informant, Indermal Ramani, bought the car from Kiran Kumar, the ex-director of Dilip Chhabria Design Pvt. Ltd. The fact that there was a purchase deed between Kanchan, the accused's spouse, and the first informant Indermal Ramani is unavoidable.

Indermal Ramani issued a notification to the accused and his sister on December 26, 2018. Despite the fact that said Indermal Ramani claims that the vehicle is registered in both Chennai and Haryana, the registration certificate filed on page 79 of the charge sheet shows that the mobile number 9952099997 was given at the time of registration of the said vehicle in Haryana. Furthermore, Dilip Chhabria's Design was identified with the owner of the car. Surprisingly, the said Indermal Ramani listed his cell phone number as 9952099997 in his police complaint dated December 19, 2020. Any of these facts are not coincidental. This fact indicates that Indermal Ramani and the accused had previously had a civil dispute. Currently, a charge sheet has been filed. The accused is 68 years old and willing to have surety with his. On the surface, I don't see why the accused should be held in custody. It is preferable to state here that the trial will take its time, and that keeping the accused in prison for an inordinate amount of time will be unjust to him.

Based on the facts mentioned above, the court issued the following order :

  1. Applicant/ Accused Dilip Harkishan Chhabria is hereby released executing his personal bond of Rs.25,000/- with one or more sureties of the like amount.
  2. The accused is permitted to deposit the provisional cash bail of Rs.25,000/- for the period of two months.
  3. The accused shall not directly or indirectly make any inducement, threat or promise to any other person acquainted with the facts of the accusations to dissuade him from disclosing such facts to the Court or to any police officer.
  4. The accused shall not leave India without prior permission of this Court.
  5. The accused shall submit the proof of his residence and two recent photographs and also submit mobile numbers and landline numbers and shall intimate change of address and change of mobile and landline numbers, if any, to the concerned court and concerned police station.
