Honest Restaurant Sues Jelly Manufacturer for Trading Under the Same Name as the Food and Snacks Giant

The Indian acclaimed chain of restaurants, Honest Restaurant has recently sued a jelly product maker due to trademark infringement. The Jelly company was continuing business and selling its products under the brand name of “Honest Jellies”

The Food Giant, Honest Restaurants have filed a suit in the City Sessions Court claiming that the company had registered its trademark “Honest” for “Honest Bhaji Pav” in 1991. On expansion, the business is currently in the process of registering a trademark worldwide. In the current suit, the restaurateur has claimed that Acme Jelly Product Pvt Ltd has been selling its product under the name ‘Honest Jellies’.

In the present lawsuit, the petitioners have stated that the defendant continues to sell their products under the trademarked name “Honest”, the defendant was likely to cause deception. The loyal customers of the Hotel might presume the jellies to be the product of Honest Hotels and other associated entities.

“It was claimed that the mark has been used since the year 1976 and as of now, has been registered in multiple jurisdictions across the world. A glimpse at the Trademark Registry website shows that the mark holds numerous registrations for “Honest” and its translated scripts, bearing numbers 1992689, 2266867, 2266868, 2817367, and 2817374, under Class 43.”

Acme Jelly Products has been sued by Honest Restaurant for trademark infringement and unfair competition
