Contempt of Court Petition Filed Against Oyo Founder Ritesh Agrawal & Director in Delhi HC

A hospitality firm, Anam Datsec has filed a contempt of court plea in Delhi High Court against Oyo Founder Ritesh Agrawal and Director Anuj Tejpal for not submitting an affidavit listing the encumbered assets. On July 7, a hospitality firm Anam Datsec filed a case against Oyo for non payment of dues for its Golden Sand property in Calangute, Goa. They have sought a damage of Rs 8 Crores.

The Delhi High Court had asked the Oyo on July 7, 2020, to file a list of its encumbered assets along with the response to the Anam Datsec and a similar affidavit in a sealed covered to the registry. But Oyo failed to fulfill all the requirements according to Anam Datsec.

Akash Nangia, Director of Anam Datsec and founder of Startups Teckjockey.com and SISL infotech has said in his statement that, Oyo and its subsidiaries were supposed to send them the list with the encumbered assets, but they failed to do so. So Anam Datsec had tried to reach to them through emails but it also went unanswered and due to that they are filing the contempt of court petition in Delhi HC.

On the reply of this, a spokesperson of Oyo said that they have fulfilled all the requirements that were asked by the court and till now they have not received any notice from the court about the filed petition. Oyo also informed the court that the dispute must be adjudicated in the arbitral tribunal as per written in agreement formed by the two parties. 

Anam Datsec has alleged in his case that the Oyo has failed to pay Rs 14 lacks per month for the property, did not provide an accurate and necessary revenue statement, and also carried out some hazardous and sub-standard construction on the property which is not according to the agreement. Besides that, Oyo also failed to furnish complete invoices against the payment of Rs 7.8 Crore made by Anam Datsec for the additional construction and did not add the other requirement that was asked to them.

Advocate Sameer Rohatgi has filed the contempt of court petition on behalf of Anam Datsec. 

The contempt petition filed by the Anam dates has been listed for August 20, when the matter will also be heard.

In June, New Delhi based Pearl Hospitality and events had taken Oyo to court alleging non-payment of dues for the existing property before the expiring of the lock-in period.
