Kangana Ranaut requests SC to transfer cases against her to Himachal Pradesh Courts

Actress Kangana Ranaut and sister Rangoli Chandel, currently part of three criminal prosecution cases because of critical remarks made on social media, recently moved to the Supreme Court in request to transfer the cases to the Courts of Himachal Pradesh. 

Advocate Neeraj Shekhar, representing petitioners, submitted that “Petitioners face a threat unto life if the trials proceed in Mumbai, because of personal vendetta of Shiv Sena leaders against the Petitioner”

The Three cases being requested to transfer being : 

  1. Criminal complaint alleging Kangana caused disharmony between Hindus and Muslims by her tweets 

The complaint was filed by Advocate Ali Kashif Khan Deshmukh before the Andheri Magistrate Court for causing disharmony and mocking the judiciary. Complainant referred to various tweets by the actor on different subjects such as, her calling the state Home Minister Anil Deshmukh 'Talibani', and so on.

The complaint being filed under Section 121, 124A, 153A , 153B , 295A, 298 , and 505 of the Indian Penal Code.

 

  1. Defamation case filed by Javed Akhtar 

This Criminal defamation complaint alleged tht Kangana made defamatory remarks on Republic TV against lyricist Javed Akhtar. It was filed in November 2020 under section 499 and 500 of the IPC. Complainant claimed that Kangana has damaged his reputation. 

The case was adjourned till March 1 2021.

  1. Sedition case filed by casting director Munawar Ali Sayyed

The complainant claimed that both the sisters tweeted with the intention of bringing hate and disaffection to the government of Maharashtra. The said tweets were alleged to be communal, creating hate and fear of communal tensions between Hindus and Muslims. The FIR was filed under Sections 153 A, 295 A, 124 A r/w 34 of IPC.
