On Sunday (June 14, 2020) Sushant Singh Rajput was found dead in his Mumbai apartment.
The Mumbai Police Department initially believed that he committed suicide. The cause of death was reported as asphyxia due to hanging in a preliminary post-mortem at Cooper Hospital.
Recently, it is being stated that a movie named, Shashank is based on the Late Bollywood actor Sushant Singh Rajputs life and the struggle of an outsider due to the nepotism in Bollywood.
A suit filed by Late Sushant Singh Rajputs father Krishna Kishore Singh has sought to restrain anyone from using the name of their deceased or likeness in movies or any web series.
According to the lawsuit, which was filed by lawyers Akshay Dev, Varun Singh, Abhijeet Pandey, and Samruddhi Bendbhar, "The defendants (filmmakers) have been trying to encash this opportunity for ulterior motives." "As a result, Plaintiff (Singh) is concerned that various plays, movies, web-series, books, interviews, or other material may be released, harming the reputation of the plaintiff's son and his family."
The suit sought damages of over Rs. 2 crores from the filmmakers for "loss of reputation, mental trauma, and abuse" to Rajput's family.
"The said right will be available to the plaintiff after his son's death as he is Sushant Singh Rajput's only legal heir," it stated.
Singh also asked the court to prohibit the filmmakers named in the suit, as well as anyone else, from using his son's "name, caricature, lifestyle, or likeness in their forthcoming project/films in any manner whatsoever," according to his plea.
On Friday (April 23, 2021) in New Delhi, Sanoj Mishra, Director of the movie, Shashank denied in the High court claiming that the movie is based on the life of an outsider in Bollywood, the struggle he/she has to face and a fight against the nepotism.
He claimed that there is so much difference in the movie so there is no comparison between the two. On April 20, the high court ordered the producers of these proposed and upcoming films to respond to the petition and set a hearing date for May 24. In his response, filed through advocate A P Singh, the director also questioned the Delhi High Court's territorial jurisdiction to hear the case.
He said that Singh is a Bihar resident, and that the FIR in connection with the actor's death was also filed there, while other pending cases are in Mumbai, and that the defendants' addresses are also in Maharashtra, and that the Delhi High Court lacks jurisdiction to hear the case.
