General Consent Granted to CBI to Probe Cases in the State Withdrawn by the Maharashtra Government [READ ORDER]

The general consent granted to CBI in the year 1989 has been withdrawn by the Maharashtra Government. The Home department via notification stated this in the public domain that the government is withdrawing the consent. The CBI or Central Bureau of Investigation is governed by the Delhi Special Police Establishment Act, 1946 and according to Section 6 of the said act; CBI cannot probe into any case without the consent of the state government. Earlier this year, Rajasthan state government also withdrew its consent. In 2018, the Andhra Pradesh and West Bengal also withdrew their consent.

The notification reads that DELHI SPECIAL POLICE ESTABLISHMENT ACT, 1946. No. MIS 2020/CR-164/POL-2.In exercise of the powers conferred by section 6 of the Delhi Special Police Establishment Act, 1946 (25 of 1946), the Government of Maharashtra hereby withdraws the consent accorded to the members of Delhi Special Police Establishment vide Government Order, Home Department, No. MIS 0189/CR-28/POL-3, dated 22nd February 1989, as also by any other instruments issued by the Government of Maharashtra, from time to time, to exercise the powers and jurisdiction under the said Act in the State of Maharashtra.
