Physical hearing to start from May 1, 3021 for UP RERA

The Uttar Pradesh Real Estate Regulatory Authority (RERA) has decided to start allowing homebuyers to appear physically with their complaints , beginning date May 1, 2021 by respective officials. 

The UP RERA has been hearing complaints through virtual means throughout the pandemic of Covid-19 in accordance with the directions set in place by the Centre as well as the state government on functioning of the e-courts system. 

On Friday (March 19, 2021), the 59th RERA meeting took place chaired by Chairman Rajive Kumar for discussion of matters related to homebuyers and builders of the state. In the meeting, a set-up of a hybrid system of Court hearings was decided to be put in place. 

The RERA was formed under the Real Estate (Regulation and Development) Act, 2016 and their basic primary work being ensuring transparency in projects, protecting the interest of consumers and to establish an adjudicating mechanism for speedy dispute redressal besides providing proper information about the builder.

The Secretary of RERA, Rajesh Kumar Tyagi said on this

The authority has henceforth decided to provide the opportunity of physical hearing to the concerned parties on their request from May 1, 2021 subject to strict compliance of COVID-19 protocol as applicable. The parties shall not be permitted to change the option of physical hearing after having opted for the same

He also pointed out that many have shown steps on physical appearances rather than online modes, he added,

 The restrictions that were placed due to the COVID-19 pandemic have also started and institutes are also opening up again as part of the unlock process. Hence, this hybrid system in which both options -- online hearing as well as physical hearing from May 1

He ensured that "All physical hearings will be conducted in strict compliance of all COVID-19 protocols", however it was strictly set that who so ever is seeking the option of physic hearing over virtual will not be allowed to switch back to the online mode later.
