Same Person Having two Aadhar Cards Bearing Different Date of Birth: Gujarat HC Directs UIDAI to Verify the Authenticity [READ ORDER]

The Gujarat High Court has directed the "Unique Identification Authority of India" (UIDAI) which is basically responsible to provide with Aadhar Cards to citizens of India that furthers them a Unique identity that could be presented anywhere in order prove authenticity. The direction given by the Gujarat HC is to verify two Aadhar Cards of the same person and sought a report on which of the cards is genuine and which of them does not produce false identification.

The report has been sought from UIDAI with regard to ascertaining the age of the women, who further claimed to be an adult, but according to her uncle who produced her Aadhar Card showed that she was a minor and further submitted that when she eloped with her boyfriend last year, she was still a minor. This happened when the women furnished an Aadhar card claiming that she is an adult with the Aadhar card date and the Aadhar Card furnished by her uncle is false which shows that she was born in 2002.

In this case, the uncle of the women had filed a petition in August 2019 complaining that she was a minor and was abducted from his lawful custody by a man in Muzaffarnagar in UP. The women's parents and siblings live in Bihar and she was with her paternal uncle in Ahmedabad. A year later, she was traced and brought to Ahmedabad and was presented by the court and she refused to meet her uncle and complained that she had left the home on her own decision because her uncle desired to marry her and therefore she had run away and got married to a person of her choice named AnandKumarShrinarayansinh and no one had kidnapped her and allegations made by her uncle are false.

The case is being probed by the "Anti-Human Trafficking Cell" because the allegations were that the minor girl was kidnapped and might have been forced to some illegal work without her permission. The Courts asserted that if her birth year is 1999 and further if she claims the same and Aadhar Card is genuine, the FIR would be considered null and void in the specific case.

The cell has forwarded both the Aadhar Card to UIDAI for verification, but the state government submitted before the HC that its direction would be required for the UIDAI to verify the cards and report the court. The matter is posted for further hearing on September 2, 2020.
