Allahabad HC Rules Over Decision of Single Bench Regarding Payment of Salaries to Teachers with Fake B.Ed. Degrees [READ ORDER]

A division bench of Allahabad High Court comprising of Chief Justice Govind Mathur and Justice Siddharth Verma has ruled over the decision of a single Bench which stayed the payment of assistant teachers of Firozabad because of fake B.Ed. degree from Agra University. The court decided this on a special appeal by Dharmendra Kumar Kansana and five other assistant teachers. They were represented by Satyendra Chandra Tripathi. 

This whole thing started when the SIT after examining the B.Ed. degrees from the colleges affiliated from the Agra University in the session 2004-05 gave its report and recommended actions stating that thousands of degrees are fake. When the matter reached the single bench, it directed actions on the teachers on the teachers appointed with the fake B.Ed. degrees banned their salaries. This appeal was filed challenging the same. 

This appeal was also connected with other special leave defective Nos. The court further ordered “It is brought to our notice that set of other special appeals questioning the correctness of the judgment impugned have already been admitted for hearing by a coordinate Bench of this court. A photocopy of the order has already been placed before us.  

It further stated, “No notice is required to be issued to respondents as they are already represented by their counsels. This appeal is connected with Special Appeal Defective Nos.318 of 2020, 319 of 2020, 320 of 2020, 427 of 2020, 428 of2020, 429 of 2020, 430 of 2020, 431 of 2020, 432 of 2020, 433of 2020, 434 of 2020, 435 of 2020, 436 of 2020, 437 of 2020and 438 of 2020. Let the appeal be listed for hearing. In the meanwhile, the effect and operation of the judgment passed by learned Single Judge shall remain stayed. The respondents shall continue the appellants in service and shall also make payment of salary on a month to month basis”. 

The council members for respondents were C.S.C., Bhupendra Kumar Yadav, Gagan Mehta, Vikram Bahadur Singh.
