Another Petition Filed In SC Against Justice Surya Kant on Nupur Sharma

Another letter petition has been filed in the Supreme Court demanding withdrawal of adverse remarks by Justice Surya Kant on Nupur Sharma. 

The petition has been filed by Vishnu Gupta - National President of Hindu Sena. 

The petitioner raises questions such as : 

1. Whether without trial or appeal or any judgement or finding of any court can the Supreme Court Judge pass such statements which effect merit of the case as well as trial ? 

2. Without any finding of any investigation agency or without judgement of any court on the findings of investigation agency can Justice Surya Kant directly jump on such controversial conclusion ?

3. Whether that Justice Surya Kant has completely ignored the religious feelings of Hindu community and have been biased and discriminatory in overlooking the derogatory remarks on Lord Shiva despite constant request to stop such humiliation by Mr. Tasleem Ahmad Rehmani on the same TV debate which led to the provoking remarks by Nupur Sharma?

4. Whether the Supreme Court has not been promoting blasphemy in India as per Sharia Law by such controversial observations leading to further havoc in the country as Hindus are deeply hurt by one sided discriminatory observations against Nupur Sharma, giving clean chit to the instigator and Mohammad Zubair, who didnt check the facts about her alleged remarks and circulated cut and doctored video to instigate his community?

This is the second petition filed in the Supreme Court after Justice Surya Kants extremely harsh and unwarranted remarks on Nupur Sharma.

A letter petition in the form of a PIL was also filed in the Supreme Court yesterday demanding the Supreme Court Bench headed by Justice Kant to withdraw the remarks against Ex BJP Spokesperson Nupur Sharma.

The PIL was filed by Mr. Ajay Gautam who is a social activist.



The Supreme Court in its order refused to give relief to Nupur Sharma who had pleaded to transfer all her FIRs to Delhi. Refusing to grant relief, Bench headed by Justice Kant made certain adverse observations about Nupur Sharma as under:

  1. Nupur Sharma is responsible for Udaipur murder case;
  2. She is responsible for fire in the country;
  3. She should tender apology before TV unconditionally;
  4. She hurt the religious sentiments of a particular community;
  5. Whatever happened in the country, only Nupur Sharma is responsible;
  6. Police failed to arrest Nupur Sharma;
  7. She is single handedly responsible for what is happening in the country;
  8. Sharmas loose tongue has set the entire country on fire;
  9. Her outburst is responsible for the unfortunate incident at Udaipur

The Petition stated that the above observations and remarks made by the Supreme Court are unwanted, uncalled for and without any merit, therefore liable to be withdrawn. 

The substantial question of law raised in the petition is:

Whether without trial or appeal or any judgement or finding of any court can this court make such statements which effect merit of the case as well as trial? 

The petitioner prays to issue appropriate orders or directions to the Bench of HMJ Surya Kant to withdraw their observation in the matter of Nupur Sharma so that she can get a fair chance of trial.
