Asharam Bapu has ulterior motives in petition seeking temporary suspension of sentences to pursue medical treatment: Rajasthan State claims in Counter Affidavit [READ AFFIDAVIT]

The State of Rajasthan filed a Counter Affidavit in the plea filed by Asaram Bapu, opposing his bail plea stating that the petition of the life convict seeking temporary suspension of sentencing to pursue medical treatment and changing his place of his custody had ulterior motive. 

The Counter Affidavit was filed challenging Rajasthan High Courts order, wherein Asharam Bapus plea seeking temporary suspension of sentences to pursue was dismissed.

The State averred that this is the third time that the Petitioner has prayed to get his sentence suspended, after two of his earlier pleas seeking to be treated at Ayurvedic and allopathic Centers had been dismissed.

The Statss Counter Affidavit places its reliance on a medical report issued by AIIMS Jodhpur highlighting the patients uncooperative nature, refusing to take medicine and injections.

The Bench comprising Justices Navin Sinha and Ajay Rastogi informed the Counsels present that they had sent instant reply on behalf of the State of Rajasthan on the morning of June 8th, 2021, and adjourned the matter to Friday.

Supreme Court, during the last hearing on the matter headed by Justice BR Gavai issued a notice and agreed to evaluate if the Petitioner can be temporarily shifted to an ayurvedic centre after Senior Advocate Siddharth Luthra has argued that the medical condition of the petitioner was dire and required immediate medical treatment.

An application was filed by Asharam for temporary suspension of sentences after her got infected by COVID-19 virus while suffering life imprisonment at Central Jail, Jodhpur after which he was shifted to AIIMS Jodhpur, where he developed internal gastrointestinal bleeding. However, his instant application for temporary suspension of sentence was dismissed.
