Attack on ED officers West Bengal moves Supreme Court against CBI probe seeks urgent listing

NEW DELHI: Seeking an urgent listing, the West Bengal government has moved the Top Court challenging the High CourtS recent order directing CBI probe against TMC leader Shahjahan Sheikh for attacking Enforcement Directorates officers. 

Before Justices Sanjiv Khanna and Dipankar Datta, Senior Advocate AM Singhvi mentioned the plea today.  The Bench asked the senior counsel to mention the plea before Chief Justice of India, Justice DY Chandrachud.

You move an application. The CJI takes note of [urgent listing] applications during lunch hour. He will order listing of the plea, Justice Sanjiv Khanna said. 

Yesterday, (Tuesday), the Calcutta High Court transferred an investigation from the SIT to the CBI pertaining to the assault on Enforcement Directorate (ED) officers who had gone to Sandeshkhali, West Bengal to raid the residence of ration-scam accused Shahjahan Sheikh. Challenging this order, the state government moved the Supreme Court.

While doing so, a division bench of Chief Justice TS Sivagnanam and Justice Hiranmay Bhattacharya also set aside an earlier order constituting an SIT with members of the state police and directed the State to forthwith transfer all papers concerning the matter to the CBI, as well as the custody of prime accused Shahjahan Sheikh. 
Interestingly, even as the matter was mentioned before the Apex Court, the Calcutta High Court today set a timeline for the State government - to hand over Sandeshkhali accused Shahjahan Sheikh to CBI by 4.15 pm on Wednesday.

On January 5, party members and supporters of Shajahan Sheikh, attacked a team of ED officers in Sandeshkhali, North 24 Parganas district. The ED team was there to investigate Sheikh in connection with alleged irregularities in the public distribution system, tied to former state minister Jyoti Priya Mallick.
