Bombay HC Extends all Interim Orders Relating to Eviction, Demolition & Dispossession Passed By Courts in Maharashtra & Goa till December 22,2020 [READ ORDER]

An order has been passed by the Bombay High Court which states that no one can be allowed to be rendered homeless during the pandemic as all the high courts of every state has passed orders to put a stay on eviction, demolition, dispossession, etc. keeping the view of the current pandemic scenario.

The order had been passed against the Pimpri Chinchwad Municipal Corporation’s plea against the National Green Tribunal (NGT)’s imposing order to stop the eviction and demolition work near riverbeds.

The Bombay High Court on Thursday (October 29,2020) passed an interim order to extend the previous passed order till December 22 regarding all the eviction and demolition work aside from the riverbeds in the state of Maharashtra due to the current ongoing pandemic situation.

A bench of Chief Justice Dipankar Dutta, Justice AA Sayed and Justice KK Tated was observing the petition filed for the rights and equalities of the poor homeless persons to be affected by such eviction and demolition work and stated the order to be extended further to provide adequate measures of justice to poor homeless who faced difficulties and being marginalized during such unavoidable pandemic situation.

The Court further implied to its order for an extension stating that though the current situation of the COvid in the state of Maharashtra has been improving for few days, yet the normalcy in the legal works and court works has not been restored yet and it would take some more period of time to restart the process of all legal activities with full functionality in the court premises.

Thus, the extension for such imposed orders was necessary as the people getting affected with such dispossession and eviction work will face difficulties to arrive at the court doors for justice and also keeping in view of following the COVID norms regulated by the State Government the extension has been made up to December 22, the court further noted.
