New Delhi: The Delhi High Court recently directed Lok Nayak Hospital to provide medical treatment to a trans woman who tested HIV positive, without demanding identification documents.
A bench of Justice Sanjeev Narula addressed a petition filed by a transgender woman seeking urgent medical intervention.
Delhi High Court Ensures HIV Treatment for Transgender Woman Despite Lack of ID
The case arose from a distressing background: the petitioner was abducted at the age of 4-5 years by a human trafficking group, confined, and subjected to sexual abuse, which resulted in her HIV-positive status. The hospital had initially denied treatment due to the lack of identity documents.
The court noted that while doctors at Lok Nayak Hospital recommended admission for HIV treatment, the petitioner faced barriers due to documentation requirements. NGOs also refused shelter, citing the same issue.

Justice Narula directed: “Lok Nayak Hospital to examine the petitioner and provide necessary treatment forthwith, notwithstanding the petitioner’s lack of identification documents.” The court also ordered authorities to arrange suitable shelter, taking into account her health and the adverse weather conditions in Delhi.
Additionally, the bench instructed the Union of India to explore possibilities for skill training as part of the petitioner’s rehabilitation. Standing Counsel Mr. Sameer Vashisht was appointed to coordinate with relevant authorities for compliance.
The next hearing is scheduled for January 9, 2025.
