 Delhi HC postpones hearing on Navneet Kalra's bail application until May 28

The hearing in the bail plea filed by businessman Navneet Kalra who was arrested in connection with the recovery and seizure of Oxygen Concentrators by the Delhi Police recently (from the 'Khan Chacha' cafe under his ownership)/was adjourned to May 28 by a Delhi Court on Tuesday. 

After hearing Advocate Vishal Gohri, who informed the Court about the adjournment sought in the matter, Duty Metropolitan Magistrate Swati Sharma adjourned the hearing. The court stated, "In any case, we will not hear the application today because the counsel has requested an adjournment. The Trial Court will hear this case on May 28th." 

After hearing the submissions of Advocate Vineet Malhotra and Additional Public Prosecutor Atul Srivastava, a Delhi Court last week denied Delhi Police's application for 5 days police custody remand for Kalra. Kalra is currently being held in judicial custody in the case. 

The Delhi Police had filed a case under Sections 420, 188, 120B, 34 of the Indian Penal Code, as well as Sections 3 and 7 of the Essential Commodity Act 1955, in order to recover over 500 oxygen concentrators from various restaurants in the national capital. The investigation has been turned over to the Crime Branch. After a two-day hearing, the Delhi High Court refused to grant Kalra interim protection from arrest. 

A single-judge bench led by Justice Subramanian Prasad denied Senior Advocate Abhishek Singhvi's request, saying orally:  "The trial court's decision has persuaded me. At this time, interim protection cannot be provided." Previously, the Sessions Court denied Kalra's anticipatory bail application. On Friday (May 7, 2021) 105 oxygen concentrators were recovered from two upscale restaurants owned by Kalra in south Delhi's Khan Market area. The case was transferred to the Crime Branch on May 8.
