Dr Jacob Puliyel has filed a petition with the support of Advocate Prashant Bhushan requesting that the separated data from clinical trials for vaccines prescribed to the Indian population under the Emergency Use Authorization issued by the Drugs Controller General of India be made public.
The petitioner also requested that the full segregated trial details for each phase of the trial be published. It was stated that petition should not be seen as a protest against the current vaccine policy.
The petition further requests that post-vaccination details be made public. Such activities could also be publicized via a toll-free call. According to the petition, the publication of segregated evidence from vaccine clinical trials, with segregation made between each vaccine and each party, cannot be compromised and must be disclosed by peer-reviewed scientific journals. According to the petitioner, a former member of the National Technical Advisory Group on Immunisation, this is a blatant breach of simple scientific disclosure standards and disclosure guidelines. According to the appeal, this is unconstitutional and a breach of citizens' interests.
The petition cites the following arguments to emphasize the importance of disclosure:
- To determine whether a particular segment of the population is more vulnerable to adverse effects.
- To ascertain adverse effects in different age groups and cultures
The petitioner has also emphasized the importance of vaccine recipients being closely watched by officials and public recording of any adverse effects, as this finding has helped diagnose the prevalence of blood clots and strokes in recipients in other countries.
"India with its huge population and numbers vaccinated should have reported these adverse events first but due to poor follow up and poor adverse events following immunisation (AEFI) evaluation and suppression of data, these events have not been put in public domain - endangering many to suffer the same fate" the plea stated.
The applicant has also asked that no arbitrary mandates for the use of the inadequately tested incidents be given, and the courts have reiterated that vaccination mandates are incompatible with the right of humans to privacy and the right to choose what is injected into their bodies.
"Coercing citizens directly or indirectly to get vaccinated is unconstitutional and violates right to life of citizens. While the government has clearly stated in numerous RTIs that covid vaccines are voluntary, there are many instances from across the country where various authorities are mandating vaccines" the plea reads.
The petitioner claims that compelling people to take vaccines under threat of losing their jobs or access to basic care is a breach of their human rights. According to the petition, while vaccines can be very useful in combating outbreaks and pandemics, they can also have serious unwanted side effects. The petition contends that before vaccines are licensed, they must be property checked and evaluated in clinical trials, and test findings must be made available for review by independent scientists. According to the petition, while emergency vaccine authorization might be appropriate in the current situation, it does not imply that citizens should be required to use them.
