FIR against Delhi Riots Accused Faizal Farooq and his wife and Lawyer for producing fake Medical Certificates to obtain Bail

The Crime Branch has registered a case against Delhi riots accused and owner of Rajdhani School Faizal Farooq, his wife Sadaf, Dr. Gajindra Nayyar, Mukesh Sangwan and Advocate Mohit Bhardwaj. 

The case has been registered on 7 July 2020. It is alleged that the accused Faizal Farooq tried to take bail on the basis of fake medical documents. For this, he got a fake medical certificate of a fake operation of his wife. It was stated in these documents that the wifes treatment and surgery has been done in a hospital in Greater Noida. On May 29, Faizal sought interim bail on this basis.

The doctor, Gajinder Nayyar, and his associate, Mukesh Sangwan, were thereafter arrested by the Crime Branch for issuing fake medical certificates to criminals so that they could apply for bail on medical grounds.

According to the FIR registered, Faisal had tried to get bail four times between March and May 2020. On May 29, Farooqs lawyer, Mohit Bhardwaj, had submitted the bail application along with the medical papers to the court in which Nayyar had opined that Faisals wife, Sadaf, was suffering from fibroid of the uterus and required surgery. To prove the genuineness of the certificate, Nayyar had mentioned that Sadaf visited his clinic at Bisrakh in Greater Noida five times between April and May.

The whole matter was revealed when the court asked the police to examine the medical documents. All the documents in the investigation turned out to be fake. It was found out that Sadaf never treated him there. After this, the doctor who made the documents was questioned who had apparently prepared fake medical documents of many more people in this way. The license of this doctor was suspended for 1 year by the Delhi Medical Council in November 2019, but despite this, he was making fake medical certificates

Gajindra stated that he was introduced to Sadaf by Mukesh Sangwan. He is also a part of the said racket. According to the Crime Branch, Advocate Mohit Bhardwaj and the people of this gang have already applied fake medical certificates to many people for surety. These people are acting like a gang. Faizal has already applied for bail in the court twice, but the court had rejected the bail application. It is worth noting that in the case of the Delhi riots, Delhi Police had presented a charge sheet against 18 accused including Faisal Farooq on Jun 3.

According to the police, the incident indicates a bigger nexus between lawyers, middlemen, and doctors. When the lawyer realized that the court had involved police, the bail application was immediately withdrawn the next day, police added in the FIR.

Delhi Medical Council (DMC) in its report had mentioned that the conduct of the doctor was highly unbecoming of a medical practitioner and revoked his name from the State Medical Register for a period of 365 days up to November 2020.
