High Court restricts the Dream11 team from using the

The High Court of Delhi had restricted the sports platform named "Dream11 team" from using the logo as well as any other trademark, which is "deceptively similar" to that of the plaintiffs trademark bearing the company, named as Sporta Technologies Private Limited.

A single-Judge bench presiding officer Rajiv Shakdher J. said that the defendant Dream11, its proprietor, partners, employees, & agents were restrained from using the mark known as "Dream 11" & the logo set or any other trademark or logo similar to that of the plaintiffs' trademarks and logo.

On Wednesday, the High Court also ordered the defendant to take down the infringing material from its social media platform. This action has been taken in consonance with the petition filed by Sporta Technologies Private Limited, who is the proprietor of the registered trademark "Dream11", which is a fantasy sports platform.

According to the plaint, the registration of the aforementioned trademark was obtained on May 28, 2009, by the plaintiff, who also claims that he is operating a website with a domain name as www.dream11.com.

The website and host provider named "GoDaddy had been directed to suspend/block the defendant's domain name dream11team.com," the bench said arraying the website registrar as a defendant to the instant proceedings, asked them to file a reply on the plaint & listed the matter for further hearing on Oct 6.

According to the plaintiffs they claim that they were aggrieved by the fact that the defendant has "slavishly adopted an identical trademark" & trade logo and, therefore, has created confusion in the minds of the consumers.
