While taking the suo moto cognizance of the issue Of subsisting interim orders, the three-judge division bench has ordered all such interim orders shall stand extended till 31st October 2020 until further orders, except any order pass by Hon'ble Supreme Court pertaining to any matter during the intervening period. The HC along with subordinate courts has exercised this extraordinary jurisdiction under article 226 and 227 of the Indian Constitution.
The Delhi HC quoted, ”Needless to clarify that in case, the aforesaid extension of interim order causes any hardship of an extreme nature to a party to such proceeding, they would be at liberty to seek appropriate relief, as may be advised”.
The court further noted that the issue of released prisoners should be taken into consideration. The released prisoner while returning to prison could be the carrier of Covid-19. It further added, “the idea is to ensure that the released prisoners do not return to prison as asymptomatic patients of COVID19, especially when the prisons are overcrowded.”
The court ordered the said order shall be uploaded on the court website to give access to this order to every authority.
