Orissa High Court extends the life term of interim orders until June 30th, 2021 [READ ORDER]

The Orissa HC stated that in the light of the recent orders passed by the supreme court in Re: Cognizance for Extension of Limitation, on 27th April, Thursday, the limitation period of filing prescribed under the general law or special laws stands extended until further orders.

The Bench comprised of Chief Justice Dr. S. Muralidhar and Justice BP Routray, while going over the Suo Moto case, stated that the necessity for it to pass any separate order regarding the mentioned issue of extension of limitation is obviated.

The Bench has published the following orders that are not covered in the above SC order:

  1. All interim orders issued or protection granted including any order requiring any compliance by the parties to such proceedings, by the apex court or any other court subordinate to it or any family or court or tribunal or any quasi-judicial forum in Orissa, has a power of superintendence, following this day and those passed thereafter, unless the given date is mentioned, shall extend till 30th June,2021.
  2. The interim orders which are of not a limited duration and are meant to operate until further order, shall continue to remain in force as normal until any specific order regarding the concerning situation is published.
  3. Filling of written-statement or return in any suit pending before any civil court or any other forum, unless specifically directed, shall remain extended till 30th June. However, it is decided that if the parties are in a position to file such written statemen, they may file it before such date.
  4. The orders of eviction, dispossession, demolition, etc. passed by the apex court or any other court subordinate to it shall remain in abeyance till 30th June.
  5. All orders granting interim protection in application under section 438 CrPC by the HC or Sessions Court and limited by time frame mentioning an expiry date, shall extend and stand till 30th June. However aggrieved parties can seek relief.

 

The court has further stated that those orders are to operate until further orders. In case of extension of interim orders causes undue discomfort to any parties they will be at the position to seek aid from the reasonable court.
