Meghalaya: The Meghalaya High Court has issued significant directives regarding plastic regulation in the state, emphasizing the need for environmental protection through effective plastic waste management.
Meghalaya HC’s Bold Step: Ban on Plastics Under 120 Microns
Chief Justice I.P. Mukerji and Justice W. Diengdoh addressed a Public Interest Litigation seeking a complete ban on plastic in the State of Meghalaya.
The Court reviewed the affidavit submitted by the Secretary to the Government of Meghalaya, Forest and Environment Department, which outlined the government’s policy decisions and actions taken for plastic waste management.
Meghalaya High Court Demands Swift Action on Plastic Waste Management
Making key observations on the nature of plastic and its environmental impact, the Court noted:
“Plastic is derived from polythene, a polymethylene. Considering its properties, it was used—and is still used—for storing materials inexpensively, securely, and durably. It is widely used to make containers, bags, bottles, and other storage materials.”
The Court highlighted the environmental concerns, stating:
“Research and experience have shown that these plastic products have some very adverse impacts on the ecosystem and environment. Plastic waste cannot be easily recycled or safely destroyed. It causes waste management problems.”
Addressing the need for immediate action, the Court issued the following directives to the government:
• To issue administrative orders or cause to be made legislation or subordinate legislation effectively banning the manufacture, marketing, and use of plastic of less than 120-micron width.
• To seize materials less than 120-micron width from manufacturers, distributors, and users.
• To take effective steps so that plastic waste is properly managed within a short period of time.
• To inspect public places, recover these items, and subject them to waste management.
The Court has directed the respondent to file a second additional affidavit showing the actions taken before the next hearing date. The matter is scheduled for its next hearing on March 11, 2025.
