"Misconceived", SC dismisses plea against proposed oath of Justice Chandrachud as CJI

NEW DELHI: The Supreme Court on Wednesday rejected a petition against proposed swearing in of Justice D Y Chandrachud as the 50th Chief Justice of India on November 9, 2022, by terming it as "misconceived".

After hearing a counsel for the petitioner, a bench headed by Chief Justice U U Lalit said, "We see no reason to entertain the petition. The petition is misconceived."

During the hearing, the petitioners counsel cited certain alleged irregularities, illegal acts by Justice Chandrachud.

Ha also claimed in a case related to Covid vaccination, Justice Chandrachud allegedly forced people to take the vaccines.

He also contended when a senior advocate appeared, Justice Chandrachud's bench had allowed tagging, but when a junior advocate appeared no tagging was allowed.

He further alleged that Justice Chandrachud's bench heard a special leave petition arising out of an order in the Bombay High Court in which his son had appeared as a counsel.

The petition was filed on the basis of a representation filed by one Rashid Khan Pathan before the President of India against Justice Chandrachud.

Various advocates bodies, including the Bar Council of India and the Supreme Court Bar Association had issued statements condemning the letter circulated against Justice Chandrachud.

On Wednesday, the petition was mentioned for urgent listing. The court agreed to hear it on Wednesday itself.
