Nagpur: The Nagpur Bench of the Bombay High Court has delivered a significant judgment overturning a sexual assault conviction, highlighting the critical importance of substantive evidence in criminal cases.

Nagpur High Court Quashes Conviction in Sexual Assault Case Over Lack of Substantive Evidence
The court addressed the case of Pradeep Gulabrao Choudhari, who was originally convicted and sentenced to 20 years in prison for sexually assaulting a 10-year-old girl. The court noted, “Except for the evidence of the medical officer, there is no other substantive evidence to prove the charge against the appellant.”
Addressing the limitations of medical evidence, the court observed, “The medical officer’s evidence can be used as corroborative evidence. In this case, the victim, the mother of the victim, and the maternal aunt of the victim have not whispered about the incident of a penetrative sexual assault.”
Medical Evidence Alone Insufficient: Key Ruling by Nagpur Bench in Sexual Assault Case
The court highlighted the judicial principle that medical evidence alone cannot establish guilt, stating, “In the absence of substantive evidence as to the occurrence of the incident, it was not proper to place implicit reliance on the medical evidence to base the conviction.”
Ultimately, the court rejected the lower court’s conviction, concluding, “The prosecution has miserably failed to prove the guilt of the appellant. The appellant, therefore, deserves to be acquitted.”
The court quashed the conviction and ordered the immediate release of the appellant.
