Nasik oxygen leak tragedy: Plea before supreme court seeks independent judicial inquiry

Mumbai based NGO has filed a PIL(Public Interest Litigation) before the supreme court seeking an independent judicial inquiry on the Nasik oxygen leak case. 

On Wednesday at least 24 patients were dead after the leakage of an oxygen tank in Dr Zakir Hussain hospital Maharashtra. Save Them India Foundation filed the petition through advocate Vishal Tiwari. 

The Plea states that:

"The country on one hand is witnessing deficiency pertaining to the medical equipment along with failed distribution policy leading to greater consequences and on the other hand, negligent action of the hospital authorities leading to leakage of oxygen and death of covid patients." 

As per the petitioner, the incident was the result of negligence and seeks for registration of FIR inthe matter under sec 304(culpable homicide) and 304A(causing death by negligence). In initial inquiry it was found that the main tank valve malfunction is the reason for the leakage . State ordered a high level inquiry to ascertain if there was any negligence onthe part of the administration. 

The Petitioner stated that," The incident is a violation of fundamental rights . Prima Facie it violates the right to life of citizens enriched in Article 21". 

The PIL also prayed for the set up of a high power committee to mobilize the administration of medical policy distribution. 

It also demanded that a probemust be undertaken by  three members of the inquiry commission under the chairmanship of a retired SC judge and two retired HC judges.
