Nirbhaya Case Update: SC To Hear Centre's Appeal Challenging Delhi HC's Verdict On Hanging Convincts

The Supreme Court on 6th of February, 2020 (Thursday) agreed to hear the plea filed by the Centre, government of the National Capital of Territory of Delhi on 7th of February, 2020 (Friday) against 5th February's Delhi High Court's decision. The High court held that the four convicts cannot be hanged separately. Additional Solicitor General K M Natraj who is appearing for the Centre, has listed the matter as urgent before a three judge bench comprising - Justices N V Ramana, Sanjiv Khannna and Krishna Murari 

The Centre and the Delhi Government moved the Supreme Court on 5th February, 2020 (Wednesday) challenging the plea's rejection by the Delhi High court against the trial court's order that had stayed the execution of four death - row convicts in the Nirbhaya Gang rape and murder case. The High Court said, "All four Convicts in the Nirbhaya Case have to be executed together, not separately" and further blamed the authorities concerned for not taking effective steps in the issuance of the death warrants after rejection of appeals of the convicts took place by the Supreme court in 2017.  On January 31st, the trial court put forth a stay "till further order" on the execution of the convicts. 

He further told the court that the jail authorities have been unable to execute the convicts in this case even though their review petitions, curative petitions and mercy pleas, of the three got rejected.
