Notice Issued Karnataka HC Marital Rape Case Supreme Court

Supreme Court issues notice in petition filed challenging Karnataka High Courts order refusing to quash rape case filed by wife against her husband & holding that exception of MaritalRape to husbands is not absolute.

Sr Adv Indira Jaising appears for respondent wife on caveat

CJI: Take notice weve to hear the matter.

Jaising: Theres been a stay on proceedings for 5 years. Judgment has just been delivered Wife has been waiting indefinitely for trial to proceed

Bench- Give date in third week of July

Jaising: charges have been framed

Sr Adv Siddharth Dave appears for petitioner: on charge..

CJI: Weve given a date, you go request the HC.

Dave: can there be notice on stay as well

Bench: well hear the matter whats the problem

Dave: 29th the trial will start.
