NEW DELHI: The Supreme Court on Monday stayed proceedings initiated before Lok Sabha Privileges Committee on a complaint by MP and West Bengal BJP chief Sukanta Majumdar for injuries suffered by him during a protest over Sandeshkhali sexual assault.
A bench of Chief Justice of India D Y Chandrachud and Justices J B Pardiwala and Manoj Misra issued notice to the Lok Sabha Secretariat seeking its response within four weeks, after hearing senior advocates Kapil Sibal and A M Singhvi.
The Privileges Committee had sought personal appearance of West Bengal Chief Secretary, State DGP and Basirhat DM and ASP at 10.30 am on Monday, February 19 a complaint filed by Majumdar.
Sibal and Singhvi on behalf of the officers contended the political activity can never be considered as a breach of privilege.
They questioned the validity of the proceedings before the Privileges Committee, contending the protest resorted to the complainant MP had nothing to do with the Parliamentary duties.
They claimed a video evidence showed that the complainant himself pushed the police personnel. "The whole complaint was based on falsehood as 38 police personnel, including eight women, suffered injuries," Sibal said.
The counsel also contended Section 144 of the CrPC was already proclaimed in the place.
Majumdar claimed injuries, brutality and life threatening injuries in the incident on Wednesday, last week.
The Privileges Committee acted on his complaint and issued notice to the officers on February 15.
