SC asks for UP Government's Policy on a Pre-Release Petition of an 80-year-old [Read Order]

SC asks for UP Government Policy

Supreme Court asks the UP Govt on the policy for the premature-release of prisoners of 80-year-old prisoners. In Kedar Yadav v. State of Uttar Pradesh, a bench headed by CJI NV Ramana along with Justices Surya Kant and Hima Kohli were asked for a pre-release of the petitioner. 

The petitioner was represented by Advocate-on-Record PV Yogeswaran.

The Bench noted that the incident was from the year 1985 and the final order was passed by the Allahabad High Court only in the year 2019.

"Taking into consideration the peculiar facts and circumstances of the case, as mentioned above, let limited notice be issued to the State of U.P. to find out whether there is any policy framed by the said State to consider the case of premature release of accused who are 80 years old or above and convicted on long-drawn trial," the Court ordered.

Taking into account the urgency in the matter, the Court directed the registry to list the matter immediately after service is complete on the State government.
