A bench of Honble Supreme Court comprising of Justice AM Khanwilker and Justice Sanjiv Khanna was hearing a plea of Senior Advocate Vivek Tankha on behalf of 2,10,000 students of class X and XII who were appearing for to take the compartment exams instructed by CBSE. The petitioner was seeking relaxation in cut-off dates for these students to take admission into the Universities. The petitioner also appealed to the court that if the students wont get admission into the colleges and universities, then their whole year would go in vain, and giving the compartment exam would be a baseless one if they dont get the admission for this academic year.

In his plea, Advocate Tankha mentioned that CBSE should declare the results prior before to the cut-off dates for taking admission into the colleges and universities as prepared by the UGC. He also requested the court to issue necessary instructions to the Union of India regarding such. The court had directed a copy of the petition to be served to the union of India accordingly.

Previously, on September 4, the bench comprising of Justice AM Khanwilkar, Dinesh Maheshwari, and Sanjeev Khanna of Honble Supreme Court ordered CBSE to file a detailed report regarding the stipulation and arrangements for conducting class X and XII compartmental exams in the mid of COvid -19 situations. The court also rejected the plea directing CBSE of the petitioner on behalf of the students which suggests the students are not forced to appear for the compartmental exams during the peak of the pandemic situations.

The Bench heard the plea and considering the facts, ordered both CBSE and UGC to work unanimously and come to a conclusive point in the most coordinate way to declare the results of the compartmental exams before the cut-offs dates as well as to give relaxations in the cut-offs dates to take admissions into colleges and universities for the students who had given the exams for the sake of the future of these students.
