SC Directs Government to Frame Policy on Issues Raised in Shaheen Malik Petition Seeks Compliance Report on Trials

New Delhi: In a significant development, the Supreme Court of India on December 11, 2025, directed the Union of India to duly consider all the issues raised in Writ Petition (Civil) No. 1112 of 2025, filed by Shaheen Malik, and to frame an appropriate policy. The direction was issued by a Bench comprising the Hon’ble the Chief Justice and Hon’ble Mr. Justice Joymalya Bagchi.

The Court recorded the statement made by the learned Solicitor General of India, who stated that “all the issues raised in the instant petition will be duly considered by the competent authority and an appropriate policy will be framed.” The Bench accordingly ordered, “Let the needful be done within a period of six weeks.”

The Court also took on record the additional facts placed on record in I.A. No. 320840 of 2025, observing, “The additional facts mentioned in I.A. No. 320840 of 2025 are taken on record. The same shall also be read as part of these pleadings.”

Further, the Supreme Court addressed the status of the ongoing trials. The Court noted, “We have also taken notice of the stage of the trial currently pending before the Rohini Courts, New Delhi.” A compliance report filed by the High Court of Jammu & Kashmir and Ladakh was taken on record. In response, the Bench requested the High Court “to issue necessary instructions for prioritising the conclusion of trial in all five pending cases, subject to any other trial involving offences of a grave nature.”

The Court also issued notice to all States and Union Territories through their respective standing counsel, returnable on January 27, 2026. The Registry was directed to forward a copy of the petition to the standing counsel for all States and Union Territories. The matter is listed for further hearing on January 27, 2026.
