SC Financial Emergency

On April 01, 2020 (Wednesday), the Supreme Court deferred for two weeks hearing on a PIL seeking imposition of financial emergency in India to deal with the situation posed by COVID-19 outbreak.

The PIL was filed by the Centre for Accountability and Systemic Change (CASE) alleging that the situation cannot be managed by Section 144 of the Criminal Procedure Code, 1973 or a notification under the Disaster Management Act, 2005 or provisions of the Epidemic Disease Act, 1897.

The body also contended that if Centre issued orders under Article 360 (3) of the Constitution, then it may be binding on the states.
