NEW DELHI: The Supreme Court has granted bail to Jitendra Narayan Tyagi previously known as Waseem Rizvi in a case of alleged hate speech lodged against him after his participation in a programme in Haridwar in December last year.
A bench of Justices Ajay Rastogi and B V Nagarathna ordered his production before a trial court within three days for his release on bail.
The court, however, asked Tyagi to give an undertaking before the Haridwar court on his participation in the trial and that he would not address electronic media or use social media and should not indulge into such alleged activities any more, directly or indirectly.
The top court also said if the petitioner violates or commits breach of any of the bail conditions, the prosecution as well as the complainant would be at liberty to move an application seeking cancellation of bail.
Tyagi was represented by senior advocate Sidharth Luthra and advocate Pulkit Srivastava.
The Uttarakhand government, represented by Deputy Advocate General Jatinder Singh Sethi submitted that the charge sheet in the FIR registered on January 2, 2022 with Kotwali police station with regard to the incident on December 16-17, 2021 has been filed on March 6, this year and the charges have also been framed on May 19.
The case was filed against Tyagi and nine other accused under Section 153A and 298 of the IPC.
Tyagi, who was granted interim bail earlier by the top court on May 17 on medical grounds, was told to surrender on August 29.
The petitioner, who held the post of chairman UP Shia Central Waqf Board, had embraced Hinduism on December 6, 2021.
He was first arrested on January 13 in the case lodged by one Nadim Ali.
